Jakarta, Jurnal9.tv – Komisi Organisasi merumuskan delapan bahasan dalam Muktamar ke-34 Nahdlatul Ulama (NU), pada 23-25 Desember 2021 mendatang. Kedelapan bahasan itu mulai dari penggantian diksi organisasi menjadi perkumpulan, memisahkan status badan khusus dari perangkat organisasi untuk kemandirian NU, hingga pemanfaatan teknologi informasi sebagai penunjang administrasi.
Ketua Komisi Organisasi Muktamar ke-34 NU H Andi Najmi Fuaidi menegaskan, pihaknya telah menyelesaikan tugas untuk menyiapkan bahasan di Muktamar NU. Menurutnya, desain bangunan NU hingga kini masih cukup menarik dan belum berubah sejak 1926. Perubahan-perubahan itu hanya terdapat di beberapa konstruksinya yang harus disesuaikan pada setiap muktamar.
Karena itulah, hal pertama yang akan dibahas dalam komisi organisasi di Muktamar NU adalah penggantian diksi organisasi menjadi perkumpulan. Menurut Andi, perubahan tersebut menjadi tuntutan karena ketika NU tetap menggunakan istilah organisasi maka tidak sesuai dengan sifat badan hukumnya sebagai perkumpulan.
Andi menjelaskan bahwa NU sebagai jamiyah diniyah ijtimaiyah tunduk pada staatsblad 1870 nomor 64 tentang perkumpulan atau produk hukum zaman Belanda yang sampai saat ini masih berlaku. Di dalam staatsblad itu, NU disebut perkumpulan.
“Jadi badan hukum itu kan macam-macam. Ada yang tunduk pada UU Ormas, UU Orpol dan yayasan. Sementara NU tunduk pada staatsblad yang sampai hari ini masih berlaku. Jadi mau tidak mau, akan menyisir sekian pasal. Ini hanya soal keseragaman konsistensi diksi saja, supaya memudahkan administrasi NU ketika keluar berelasi dengan pihak lain. Jadi istilah organisasi, diganti diksinya menjadi perkumpulan,” kata Andi dalam konferensi pers, di Gedung PBNU Jakarta, Senin (13/12/2021).
Kedua, komisi organisasi akan membahas isu yang terkait dengan tema Muktamar ke-34 NU yakni Satu Abad NU: Kemandirian dalam Berkhidmat untuk Peradaban Dunia. Karenanya, komisi organisasi akan mengkaji ulang beberapa pasal yang berhubungan dengan kemandirian.
Andi menerangkan, pada forum muktamar nanti akan dibahas soal perangkat organisasi yang di dalamnya terdapat badan khusus, sebuah badan yang berorientasi pada keuntungan, baik materi maupun sosial.
“Misalnya soal perangkat organisasi yang di dalamnya ada badan khusus. Badan khusus ini adalah sebuah badan yang berorientasi pada keuntungan, baik profit yang bersifat materi maupun sosial. Itu letaknya ada di badan khusus,” jelasnya.
Ketika badan khusus dikeluarkan, maka akan mendongkrak berbagai usaha yang berorientasi pada keuntungan. “Tujuannya agar implementatif. Ini dibangun dan nanti nyambung dengan perubahan dalam pasal soal sumber-sumber keuangan NU,” tambah Andi.
Masih terkait dengan kemandirian, komisi organisasi juga merevisi pasal terkait sumber keuangan dan kekayaan NU.
Keempat, Komisi Organisasi Muktamar NU akan membahas soal kewenangan Pengurus Wilayah Nahdlatul Ulama (PWNU) untuk memberikan pengesahan bagi kepengurusan di tingkat Majelis Wakil Cabang Nahdlatul Ulama (MWCNU).
“Di dalam Muktamar ke-33 NU di Jombang, kewenangan PWNU untuk mengesahkan kepengurusan di MWC atau level administrasi kecamatan, itu diambil PCNU (Pengurus Cabang Nahdlatul Ulama), satu level di atasnya. Padahal sebelumnya kewenangan itu ada di dua level di atasnya,” jelas Andi yang juga Wakil Sekretaris Jenderal PBNU itu.
Sementara kepengurusan satu tingkat di atasnya, PCNU misalnya, hanya memiliki kewenangan untuk memberikan rekomendasi kepada PWNU untuk mengesahkan kepengurusan di level MWCNU.
Isu kelima di dalam Komisi Organisasi Muktamar NU adalah soal wewenang dan tugas pengurus. Andi menjelaskan bahwa ada satu hal yang menjadi perhatian khusus, yakni soal kewenangan rais ‘aam di dalam dan luar pengadilan.
“Ini untuk menjaga marwah jabatan rais ‘aam, sehingga jabatan rais ‘aam tidak dilibatkan dalam urusan-urusan di dalam maupun luar pengadilan, yang terkait dengan hukum positif. Itu cukup diwakilkan oleh ketua umum. Konteksnya menjaga marwah, supaya tidak terseret-seret dalam urusan pengadilan,” terang Andi.
Bahasan keenam adalah soal evalusasi kepengurusan. Dijelaskan Andi, kepengurusan NU di setiap level tidak cukup dievaluasi hanya di dalam permusyawaratannya saja. Seperti PBNU di forum muktamar, PWNU dan PCNU di dalam konferensi.
“Itu tidak cukup hanya setiap lima tahun evaluasinya. Tetapi perlu ada evaluasi secara rutin, yang berbasis indikator-indikator. Misalnya, pengurus wilayah dan cabang nanti bisa diklasifikasikan menjadi kategori A, B, dan C,” jelasnya.
Dicontohkan, PWNU dan PCNU akan mendapat kategori A jika dalam satu tahun bisa melaksanakan kaderisasi minimal dua kali. Kemudian memiliki usaha di bidang kesehatan, seperti rumah sakit dan klinik, serta punya puluhan lembaga pendidikan.
Di samping itu, indikator kategori A adalah memiliki struktur kepengurusan lengkap. Misalnya, PWNU memiliki PCNU lengkap di setiap kota dan kabupaten, PCNU memiliki struktur MWCNU lengkap di seluruh kecamatan.
“Tetapi kalau selama satu tahun ternyata kaderisasi hanya sekali, usaha hanya punya klinik dan tidak punya lembaga pendidikan atau sebaliknya. Mungkin masuknya kategori B. Kalau tidak pernah melaksanakan kaderisasi dan tidak memiliki usaha, maka masuk kategori C atau klasifikasi terendah,” terang Andi.
Ketujuh, isu yang akan diangkat di dalam Komisi Organisasi Muktamar NU adalah tentang tata urutan peraturan di lingkungan NU. Andi mengatakan, hingga Muktamar ke-33 di Jombang, NU belum berhasil membuat klausul tentang urutan peraturan itu.
Tata urutan peraturan di lingkungan NU itu mulai dari qanun asasi, anggaran dasar, anggaran rumah tangga, peraturan perkumpulan NU, peraturan pengurus besar, peraturan pengurus wilayah, peraturan pengurus cabang, peraturan badan otonom di masing-masing tingkatan, hingga dengan ketentuan lembaga.
“Mudah-mudahan ini bisa diputuskan dan masuk ke dalam salah satu pasal di dalam ART yang akan datang,” harap Andi.
Terakhir, Komisi Organisasi Muktamar NU telah membuat klausul mengenai pemanfaatan teknologi informasi. Menurut Andi, regulasi NU harus bisa memanfaatkan perkembangan IT meskipun baru sebatas penunjang administrasi.
“Jadi dalam kondisi-kondisi tertentu, permusyawaratan di lingkungan NU boleh menggunakan platform IT atau virtual. Itu akan sah secara hukum. Mudah-mudahan semuanya bisa diterima oleh peserta muktamar. Kalaupun ada perdebatan, semoga perdebatannya memperbaiki apa yang sudah dirumuskan, bukan sebaliknya,” pungkas Andi. (*)
